Our client caused a commotion, argued, pushed and punched a security guard whilst he was intoxicated on the day of offence.
He was charged with the following:
- Section 3(1)(a) of the Protection from Harassment Act 2014 (“POHA”); and
- Section 290 of the Penal Code 1871 (“PC”); and
- Section 352 of the Penal Code 1871 (“PC”)
He could have been liable on conviction with the following:
- Section 3(2) POHA – Intentionally causing harassment, alarm or distress
Any individual or entity that contravenes subsection (1) shall be guilty of an offence and, subject to section 8, shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.
- Section 290 PC – Public nuisance
(a) with fine which may extend to $2,000;
(b) in the case where the offender knew that the act or omission constituting the public nuisance will cause or will probably cause any common injury, danger or annoyance to the public, or to the people in general who dwell or occupy property in the vicinity, with imprisonment for a term which may extend to 3 months, or with fine which may extend to $2,000, or with both; or
- Section 352 PC – Using criminal force otherwise than on grave and sudden provocation
…shall be punished with imprisonment for a term which may extend to 3 months, or with fine which may extend to $1,500, or with both.
Outcome:
To assist our client in his legal proceedings, we sent representations, presented legal arguments and mitigating factors. Fortunately, our representation was accepted.
