Section 375 (1) of the Penal Code 1871 states that any man who penetrates the vagina of a woman with his penis —
(a) without her consent; or
(b) with or without her consent, when she is below 14 years of age,
shall be guilty of an offence.
The element of consent is critical as it determines whether someone would be convicted under this act. The complainant’s testimony may play a role to determine this. However, for certain sexual offences, consent is not required. For example:
- Incest
- Rape/sexual intercourse with someone under 14 years old
- Sexual penetration of a minor (someone between 16 and 18 years old) who is in an exploitative relationship.
Case Example
Our client was being investigated for a possible rape charge.
