Section 3(1)(c) of Protection from Harassment Act 2014 – Publishing with the intention to cause harassment, alarm or distress

Our client is a well-known financial blogger who got into an online dispute which had escalated. Her personal detail was revealed online and this had caused her great distress.

Doxxing, under Section 3(1)(c) of Protection from Harassment Act 2014 (POHA) makes it an offence if you publish identity information about a person, or a person related to that person, with the intention to cause harassment, alarm or distress to the victim and, in fact, causing such harassment, alarm or distress.

We met our client and following the consultation, we drafted a cease and desist letter within 1 day after she signed the Warrant to Act. To bring further action to court with a lawyer would be expensive, hence we had advised our client alternative cost-efficient suggestions. We encouraged her to represent herself and provided her guidance to equip herself for it. This has helped her situation, and the outcome was favourable to her. The matter was eventually resolved and she had sent us the following message:

“I just wanted to say a huge thank you for helping me through this, and that I appreciate having had you with me through this crisis!”
